TERMS AND CONDITIONS
- INTRODUCTION
All online purchase transactions for the supply of products by Kalo shall be subject to these standard terms and conditions of sale. These terms and conditions will always be subject to the provisions of the Consumer Protection Act, Act 68 of 2008, as amended and read with its Regulations (”the Act”).
- PURCHASE
2.1 Kalo and the Customer agree to be bound by these standard terms and conditions of sale in transactions relating to the purchase of the products of Kalo.
2.2 Customers can register online prior to purchasing, thereby accepting Kalo’s terms and conditions.
- ORDERS
Purchase orders will be made online and in store. Kalo reserves the right to decline any order.
- PAYMENT
4.1 Payment by the Customer shall be made either by online credit card payment i.e. Payfast or by electronic funds transfer.
4.2 Kalo undertakes to maintain strict confidentiality in respect of the Customer’s credit cards and account information.
4.3 Ordered goods will not be despatched unless payment as aforementioned is finally processed and finalised.
- DELIVERY
5.1 Kalo will endeavour to process delivery by despatching ordered goods by not later than seven (7) days after notification to Kalo of confirmation of payment by the Customer for the ordered goods. Ts and Cs apply. Please refer to our Shipping and Delivery tab for more information.
5.2 Delivery costs other than to a major centre within the Republic of South Africa will be quoted in addition to the standard costs recorded in clause 5.5 and will be for the Customers account.
5.3 Kalo’s designated courier will endeavour to deliver on three occasions and if unsuccessful the Customer will be liable for the expense of further attempts by the couriers to deliver.
5.4 The Customer will be able to fast track progress of delivery.
5.5 Costs of delivery are R100.00 including VAT, door to door nationwide within the Republic of South Africa, as indicated in the designated map. Reference to the map is accessible online.
5.6 Delivery will only be affected in the territory of the Republic of South Africa.
- OWNERSHIP
Ownership in respect of the goods will remain vested in Kalo until fully paid for by the Customer.
- CUSTOMERS RIGHT TO CANCEL/ RETURN
7.1 The Customer has the right in terms of Section 17 of the Act to cancel an order for goods. Upon notice of such cancellation the Supplier will be entitled to require payment of a reasonable charge for the cancellation of the order which charge shall be not less than the initial costs of despatch of the goods by Kalo and also the costs of return despatch of the goods by the Customer to Kalo. Kalo shall be entitled to deduct its reasonable charges from the amount to be refunded to the Customer.
7.2 Any cancellation shall be effected by the Customer within ten (10) days after delivery to the Customer of the goods, in compliance with Section 20(2)(d) of the Act.
7.3 The Customer will not use or abuse the goods if the Customer avails itself of its right to cancel the transaction as contemplated in this clause 7.
7.4 In the event that the Customer returns ordered goods, any exchange order shall be deemed to be a new order and shall be subject to all terms and conditions of this agreement.
7.5 The return of goods will be pre-arranged with Kalo for which purpose the Customer will complete the prescribed product return form available online and which will be forwarded to Kalo. Kalo will forward a return authorisation document to the Customer which document shall accompany the returned goods.
7.6 The return goods shall be properly protected in its original packaging and in unused and undamaged condition when dispatched to Kalo.
7.7 Costs of return will be for the account of the Customer.
- GIFT VOUCHERS
Kalo will upon request make electronic gift vouchers available for purchases online. Such gift vouchers will be valid for a period of twelve (12) months after purchase.

- WARRANTY
10.1 Kalo acknowledges that the goods have an implied warranty that the goods are reasonably suitable for the purposes for which they are intended. The warranty provisions of the Act shall apply subject that the warranty will terminate on any of the following incidents:
10.1.1 faults resulting from normal wear and tear;
10.1.2 damage arising from incorrect usage or wash care;
- BREACH
Should the Customer fail to make any payment to Kalo under any contract or should the Customer be in breach of the provisions of these terms and conditions and fail to remedy such breach seven (7) days after receiving written demand that it be remedied Kalo shall be entitled without prejudice to any other remedy to cancel the agreement with the Customer with immediate effect.
